The legal provisions of commutation need amendment to the effect that for common place murders 25 years prison service is minimum and for terrorist murders etc 40 years is the minimum, in the larger interest of criminal justice system. Criminal law varies according to jurisdiction, and differs from civil law, where emphasis is more on dispute resolution and victim compensation than on punishment. Criminal procedure is formalized official activity that authenticates the fact of commission of a crime and authorizes punitive treatment of the offender. These are at best core definitions; they do not comprehend all legal systems, all stages in the development of a legal system, or all elements within a given legal system. For any national survey measuring rape and sexual assault victimizations, uniform definitions of those victimizations are needed. Because the Bureau of Justice Statistics (BJS) focuses specifically on criminal victimization, these definitions need to conform as much as possible to existing legal definitions. Because the crimes of rape and sexual assault fall mostly under state rather than federal criminal statutes and these statutes are not uniform across jurisdictions, this presents an immediate difficulty. The book suggests total recasting of penal, procedural and law of evidence to make it victim oriented and not accused centric.
